Paying rent by cheque in Dubai

Dubai rent is usually paid by post-dated cheques, typically 1, 2 or 4 a year. Since 2 January 2022 (Federal Decree-Law 14 of 2020), a cheque bounced for insufficient funds is no longer a crime but is directly enforceable. Law 33/2008 allows eviction if rent stays unpaid 30 days after notice.

Paying rent by cheque in Dubai

Dubai rent is usually paid by post-dated cheques, typically 1, 2 or 4 a year.

Step by step

  1. Agree the number of cheques and the payment method in the Unified Tenancy Contract.
  2. Ask whether fewer cheques earns a lower rent (market practice).
  3. If a cheque bounces, the bank must pay whatever partial amount the account holds, unless the payee declines.
  4. The landlord can take a bounced cheque straight to the execution court, or serve a 30-day notice to pay and then seek eviction (Law 33/2008 Art. 25(1)(a)).

Questions

Can I go to jail for a bounced rent cheque?

Not for insufficient funds after 2 January 2022. Deliberate stop-payment orders, closing the account and forgery remain criminal (Afridi & Angell summary of Federal Decree-Law 14/2020; law-firm source).

How many cheques is normal?

There is no official rule. Market sources say 4 is the usual default and 12 is rarer. Gulf News (Jan 2022) expected landlords to accept fewer cheques after decriminalisation.
